These Terms of Service (“Terms”) govern your use of the NōD application (“App”) and the website at nod-ai.com, provided by NōD (“Company”, “we”, “us”, “our”). By accessing or using the App or website, you agree to be bound by these Terms.
By creating an account or using the App, you confirm that you are at least 16 years of age (or the age of digital consent in your jurisdiction) and agree to these Terms. If you do not agree, do not use the App.
2.1 You must provide accurate, current, and complete information during registration.
2.2 You are responsible for maintaining the confidentiality of your account credentials.
2.3 You are responsible for all activities that occur under your account.
2.4 You must notify us immediately of any unauthorized use of your account.
3.1 NōD is a personal AI-powered information management application that aggregates data from your connected accounts (email, calendar, and related sources) and provides intelligent summaries, notifications, and actions.
3.2 The App may integrate with third-party services (Google, Microsoft, Apple) via OAuth. Your use of those services is governed by their respective terms.
3.3 AI features are provided on a best-effort basis. AI-generated content may contain errors and should not be relied upon as the sole basis for important decisions.
4.1 Our collection and use of personal data is governed by our Privacy Policy.
4.2 You retain ownership of all data you provide to the App.
4.3 You grant us a limited, non-exclusive license to process your data solely to provide and improve the App’s services.
You agree not to:
6.1 The App, including its design, code, features, and content (excluding user data), is owned by NōD and protected by intellectual property laws.
6.2 You may not copy, modify, distribute, or create derivative works of the App without our prior written consent.
7.1 The App offers free and paid subscription tiers.
7.2 Paid subscriptions are billed in advance on a recurring basis (monthly or annually).
7.3 Payments and subscription management may be processed by Stripe, Apple App Store, or Google Play depending on where you subscribe.
7.4 You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
7.5 Refunds are provided in accordance with applicable consumer protection laws and the policies of the platform through which you subscribed.
8.1 The App may use third-party AI providers, including OpenAI or user-configured providers, to process your data.
8.2 When you provide your own API keys for external AI services, you are responsible for compliance with those services’ terms.
8.3 We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
9.1 You may export your data at any time through the App’s settings (Data Export).
9.2 You may request deletion of your account and associated data at any time.
9.3 Upon account deletion, we will remove your personal data within 30 days, except where retention is required by law.
10.1 To the maximum extent permitted by law, NōD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
10.2 Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10.3 These limitations do not apply where prohibited by law, including EU consumer protection regulations.
You agree to indemnify and hold harmless NōD from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.
12.1 We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance.
12.2 Continued use of the App after changes take effect constitutes acceptance.
13.1 We may suspend or terminate your account for violation of these Terms.
13.2 You may terminate your account at any time by deleting it through the App’s settings.
13.3 Upon termination, your right to use the App ceases immediately. Data deletion follows the process described in Section 9.
14.1 These Terms are governed by the laws of the jurisdiction in which NōD is incorporated.
14.2 For EU residents: you retain all rights under EU consumer protection laws, including the right to bring proceedings in your country of residence. Nothing in these Terms limits your statutory rights.
14.3 For US residents: any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
